Two areas of this policy describe regulatory positions that were current as of our August 2026 research but move often and should be re-verified before this page is treated as final: (1) the status of the FCC's "one-to-one consent" rule under the Telephone Consumer Protection Act, discussed in Section 8, and (2) the current list of states with comprehensive consumer privacy laws and the scope of their Gramm-Leach-Bliley exemptions, discussed in Section 7.

2. Information We Collect
Information you give us directly, primarily through our online quote form, by phone, or by email:
- Contact information (name, mailing address, phone number, email address)
- Vehicle information (year, make, model, VIN, modifications, storage location, mileage)
- Driver information (driver's license number and state, driving history, date of birth)
- Insurance history (current or prior carrier, coverage limits, claims history)
- Any other information you choose to provide in the course of requesting a quote or a claim
We generally do not seek or need health or medical information to quote collector-vehicle coverage. If health-related information becomes relevant (for example, in connection with certain injury-related coverage or a claim), we will only use or disclose it for the purpose for which it was provided, and, where required by law, will obtain your written authorization before disclosing it for marketing purposes.
Information collected automatically, when you visit the Site:
- IP address, browser type and version, device type, operating system
- Pages visited, time on page, referring and exit pages, general geographic location (derived from IP)

Information from third parties, such as motor vehicle records, consumer or credit reports (where permitted by applicable law and used for underwriting purposes by carriers, not by us directly), and information the carriers we work with share back with us in the course of servicing your request.
Collectively, financial and insurance-related information about you that is not publicly available is referred to in this Policy, consistent with the Gramm-Leach-Bliley Act, as "nonpublic personal information" or "NPI."
3. How We Use Your Information
We use the information described above to:
- Prepare and obtain insurance quotes from carriers on your behalf
- Communicate with you about your quote request, application, policy, or claim
- Service and maintain, where applicable, an existing policy relationship
- Comply with legal, regulatory, and insurance-licensing obligations
- Detect and prevent fraud
- Improve the Site and our marketing (using aggregated or de-identified data where feasible)
- Send you marketing communications, where you have provided consent as described in Section 8
4. How We Share Your Information
As a licensed insurance producer, we share NPI with:
- Insurance carriers and their agents or MGAs, in order to obtain and bind the coverage you requested — this is the core function of an independent agency and is necessary to provide the service you asked for.
- Service providers who perform functions on our behalf (for example, website hosting, phone and CRM systems, and email delivery), under agreements that restrict their use of your information to providing services to us.
- Professional advisors and regulators, as required to comply with law, respond to legal process, or as part of our licensing obligations to state departments of insurance.
- In connection with a business transfer, such as a merger, acquisition, or sale of assets, subject to applicable law.
We Do Not Sell Your NPI
We do not sell your NPI to third parties for their own independent marketing purposes. Where the Gramm-Leach-Bliley Act and its implementing state regulations would otherwise require us to offer an opt-out before sharing NPI with a nonaffiliated third party for purposes other than completing your requested transaction, we will provide that opt-out. Sharing with carriers to obtain your quote, and sharing with our own service providers, generally falls within recognized exceptions to the opt-out requirement (because it is necessary to service the transaction you requested, or is disclosure to a service provider performing functions on our behalf) and does not require a separate opt-out.
5. Your Choices
- Marketing communications: You can opt out of marketing emails at any time using the unsubscribe link in any such email, or by contacting us at Info@musclecarinsurance.com. Opting out of marketing does not opt you out of servicing communications about an active quote, application, or policy.
- Phone and SMS: See Section 8 below regarding consent for calls and text messages.
- NPI opt-out: To the extent applicable, you may direct us not to share your NPI with nonaffiliated third parties outside the exceptions described above by contacting us using the information in Section 1.
6. California Privacy Rights (CCPA/CPRA)
This section applies to California residents to the extent [LEGAL ENTITY NAME — to be completed] is a "business" as defined by the CCPA/CPRA — a determination that depends on the Agency's annual revenue and the volume of California consumer data it processes, thresholds that may or may not be met, and which we should confirm are or are not met before relying on this section as a complete compliance statement.
Personal information we collect, process, or disclose in connection with obtaining or servicing an insurance quote or policy — governed by the Gramm-Leach-Bliley Act — is exempt from the CCPA under Cal. Civ. Code Section 1798.145(e). This exemption is limited to that GLBA-covered information; it is a data-level exemption, not an entity-level one. It does not exempt other categories of personal information the Site may collect, such as general website analytics data, from the CCPA.
To the extent the CCPA/CPRA applies to information not covered by the GLBA exemption, California residents have the right to: know what personal information we have collected; request deletion of personal information; correct inaccurate personal information; opt out of the sale or sharing of personal information; and limit the use of sensitive personal information. We do not sell personal information for money. To the extent our use of analytics or advertising cookies constitutes a "share" under the CPRA's definition, you may opt out using [COOKIE-CONSENT TOOL, IF IMPLEMENTED — to be completed] or by setting a Global Privacy Control signal in your browser, which we will honor. 7. Other State Privacy Rights
Residents of a growing list of other states — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana, among others — have similar rights to access, delete, correct, and opt out of certain processing of their personal data under their respective state privacy laws. As of our August 2026 research, roughly twenty states had comprehensive consumer privacy laws in effect; that count changes as new state laws take effect, so it should be re-checked rather than relied upon as fixed.
Many of these statutes contain a broader exemption than California's for information and entities regulated by the Gramm-Leach-Bliley Act — an entity-level exemption for GLBA-regulated financial institutions, rather than California's data-level-only exemption. This may mean this Agency, and the data it processes in connection with insurance quoting, is exempt from a given state's law in whole. Where a state law applies to us and to data not otherwise exempt, we will honor requests submitted to Info@musclecarinsurance.com in accordance with that law.
8. Communications Consent (Phone, Text, and Email)
By submitting the quote form or otherwise providing your phone number to us, you consent to being contacted by [LEGAL ENTITY NAME — to be completed] at that number, including by call or text message, regarding your quote request. Where we or our marketing partners use an automatic telephone dialing system or an artificial or prerecorded voice to contact you for marketing purposes, we will obtain your prior express written consent as required by the Telephone Consumer Protection Act (TCPA), including clear disclosure that you are agreeing to receive such calls or texts and that consent is not a condition of any purchase. Message and data rates may apply; message frequency varies; reply STOP to opt out of text messages and HELP for help.
A Note on the FCC's "One-to-One Consent" Rule
An FCC rule that would have required a separate, logically-related consent for each individual marketing partner was vacated by the U.S. Court of Appeals for the Eleventh Circuit in January 2025, and the FCC subsequently moved to formally rescind it rather than seek further review. As of our August 2026 research, that one-to-one requirement is not in force at the federal level, and the pre-2024 single-consent standard applies. Some states maintain their own, stricter "mini-TCPA" calling and texting rules independent of federal law. This is a live regulatory area and should be re-verified before this page is relied upon as final.
We comply with the CAN-SPAM Act for commercial email: we identify ourselves clearly, do not use misleading subject lines, and provide a working opt-out link in every marketing email, honored within 10 business days.
9. Cookies and Analytics
The Site uses cookies and similar technologies, including [ANALYTICS/AD TOOLS IN USE — to be completed], to understand how visitors use the Site and to support advertising. You can control cookies through your browser settings; disabling cookies may affect Site functionality. The Site does not currently respond to browser Do Not Track signals, as there is no common industry standard for how to interpret them, but we do honor Global Privacy Control signals for California residents as described in Section 6.
10. Data Security
We maintain administrative, technical, and physical safeguards designed to protect your information, consistent with our obligations under the Gramm-Leach-Bliley Act Safeguards Rule and, to the extent applicable in our licensed states, state insurance data security laws based on the NAIC Insurance Data Security Model Law. State adoption of that model law varies and has been expanding; the specific breach-notification duties that apply to us depend on the states in which we are licensed and domiciled. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to service your quote request or policy, satisfy legal and regulatory recordkeeping obligations applicable to licensed insurance producers, and resolve disputes.
12. Children's Privacy
The Site is not directed to, and we do not knowingly collect personal information from, children under the age of 13. If we learn we have collected personal information from a child under 13, we will delete it.
13. Third-Party Links
The Site may link to carrier websites or other third-party sites. This Policy does not apply to those sites, and we encourage you to review their privacy policies separately.
